The Severe Weather Emergency Legislation Act

New legislation has been enacted which ease specific compliance requirements for businesses affected by recent severe weather events including: resource consenting requirements for preventative or remedial activities under the RMA; and registration requirements under the Food Act 2014 and Food Regulations 2015. Financial Support and Assistance

Work and Income are offering financial assistance for those affected by Cyclone Gabrielle and information is available here. You will also find a summary of all support currently available on the Civil Defence website here.

MPI Business Support Package

The new business support package announced by the Government on 29 June 2023 for those affected by the North Island weather events is now open.

The package is available to businesses, orchards, and farms in Northland, Auckland, Waikato, Bay of Plenty, Tairāwhiti, Hawke's Bay, Tararua, and Wairarapa. It includes:

  • a Loan Guarantee Scheme that enables commercial lenders to provide loans to highly affected businesses across all sectors with more favourable terms, such as reduced interest rates.
  • the North Island Weather Events Primary Producer Finance Scheme that provides concessionary loans and equity finance to severely impacted, land-based primary sector businesses.

Primary Producer Finance Scheme

The North Island Weather Events Primary Producer Finance Scheme is designed for businesses that have a reasonable chance of returning to viability with additional support. It aims to help these businesses re-engage with commercial lenders. The scheme is administered by Kānoa, Regional Economic Development & Investment Unit at the Ministry for Business Innovation and Employment.

The Primary Producer Finance Scheme is open for applications and Expressions of Interest for six weeks, from 31 July to 8 September 2023.

Rural recovery funding - update from MPI

The Government is providing $4 million to help farmers, growers, whenua Māori owners and rural communities mobilise and co-ordinate recovery efforts. Read more here. This is initial funding to help with immediate and urgent needs. MPI is working closely with sector groups, including NZW, to identify areas of greatest need. They envisage the money may be used to:

  • help get generators to isolated rural areas without electricity
  • help re-establish vital lines of communication
  • support the immediate response
  • to conduct aerial assessments (this imagery was critical in recovery planning after the Canterbury floods in 2021)
  • mobilise and co-ordinate initial clean-up in rural areas.

Importantly, MPI will be working with the national response to ensure this is not replicating work already being done. At this point, individuals/businesses are not able to directly apply for this funding. Further support will be considered as full assessments of damage are carried out.

Hawke’s Bay Disaster Relief Trust

The Hawke's Bay Disaster Relief Fund provides financial support to residents and ratepayers of the Hawke’s Bay region who have been affected by Cyclone Gabrielle. This one-off hardship grant provides for damage or hardship incurred as a result of the cyclone. More information is available at the link below.

    Hawke's Bay Disaster Relief Fund

    The Hawke's Bay Disaster Relief Fund is designed to help Hawke’s Bay communities, individuals, families, community organisations and marae get immediate access to funds to assist with recovery.

MSD Community Support Package 

The Ministry of Social Development has provided a Community Support Package which aims to relieve pressure on community groups and contracted providers so they can continue to deliver their response and recovery efforts for individuals, whānau and communities. More information is available in the fact sheet below.

    MSD Community Support Package

    The Community Support Package for response and recovery efforts includes:

    - Community support fund ($2 million) 
    - Provider support fund ($4 million)  
    - Food fund ($1 million) 
    - Support through Community Connectors ($4 million) 
    - Support for disabled people ($0.5 million) 

ACC support

ACC is offering:

  • Support to those injured as a result of the flooding and emergency response, including mental injury cover and support.
  • The cost of any additional payments for medical support from a GP, nurse, nurse practitioner or Urgent Care for an ACC covered injury will be covered by ACC for those in the Hawke’s Bay or Gisborne regions between 19 February and 19 March 2023.
  • Additional support for existing ACC clients in impacted regions.
  • Automatically extended medical certificates for most people in impacted regions.
  • Support to the families of those who have passed away.
  • Options for payment of levies for those concerned about their financial situation.

IRD support

Inland Revenue (IRD) is offering support for those impacted by the recent weather events. More information is available here, but it includes:

  • tax relief, such as the removal of any late filing and payment penalties and, at its discretion, tax or interest owed; and
  • allowance of late deposits to and early withdrawals from the income equalisation scheme.

If you have been impacted, when you are able to, contact IRD either via myIR including the word ‘cyclone’ or by calling their disaster line on 0800 473 566.

Employment New Zealand have information for employers and employees around payment options and Health and Safety during natural disasters available here.

Recovery visa

To assist with recovery, the Government has announced the launch of the Recovery Visa (a Specific Purpose Work Visa). This short-term visa (lasting up to six months) will allow employers to sponsor migrants to come to New Zealand to work on the emergency response.

To apply:

  1. Employer finds migrant worker/s that meet the requirements to assist with the recovery.
  2. Employer downloads and completes the Recovery Visa – Employer Supplementary form and provides this to the migrant worker.
  3. Migrant worker completes a Specific Purpose Work visa application, uploads/attaches the Recovery Visa – Employer Supplementary Form and specifies length of stay in New Zealand as 6 months or less (note that the $700 fee will be refunded for successful applicants).
  4. Immigration NZ (INZ) processes the application and provides applicant with a decision.

INZ aims process applications for the Recovery Visa within a week and many will be decided even quicker. See here for more information.

Other visa options

Employers wanting to recruit migrant workers for longer term roles are encouraged to use the existing Accredited Employer Work Visa (AEWV). Changes are being considered to this visa to support faster processing for identified roles that will support the recovery and rebuild. These roles will be exempt from the labour market test. More information on other visa pathways can be found here.

Migrant workers in New Zealand

Migrants already in New Zealand who need to change their role and location to assist with recovery will be able to do so for up to two months without breaching their visa conditions. They must stay with the same employer.

MSD Employer Support - Cyclone Gabrielle

MSD can provide a range of business support for employers to assist in the recovery effort following Cyclone Gabrielle including staff retention, staff redeployment (temporary or permanent) and early response business closures. If you have had to make staff redundant, MSD may also assist with re-training, finding another job and financial support. Dealing with waste from Cyclone Gabrielle

Hawke's Bay Regional Council has shared advice on how to deal with waste as a result of Cyclone Gabrielle. The advice covers how to deal with different waste types, including: 

  • Livestock carcass removal 
  • Silt removal 
  • Wood waste 
  • Posts and wire

Silt removal

If you have silt waste on a lifestyle block, farm or orchard, Hawke's Bay Regional Council (HBRC) can help remove larger volumes. Call HBRC on 06 835 9200 or 0800 108 838 and they will coordinate with a contractor to get it removed. Landowners are asked to remove the silt from around vines or trees and move it to a location on their own property with access for trucks.

Update on orchard waste burning

At this time of the year orchardists are permitted to burn certain vegetation outdoors during May, June, July, and August, and normally the burning of prunings is NOT permitted. However, in the aftermath of Cyclone Gabrielle, prunings CAN be burnt in an effort to save trees and on affected land that is being cleared, including in airsheds. Full details can be found in the Council's full media advisory here
