New legislation has been enacted which ease specific compliance requirements for businesses affected by recent severe weather events including: resource consenting requirements for preventative or remedial activities under the RMA; and registration requirements under the Food Act 2014 and Food Regulations 2015. Work and Income are offering financial assistance for those affected by Cyclone Gabrielle and information is available here. You will also find a summary of all support currently available on the Civil Defence website here.
The new business support package announced by the Government on 29 June 2023 for those affected by the North Island weather events is now open.
The package is available to businesses, orchards, and farms in Northland, Auckland, Waikato, Bay of Plenty, Tairāwhiti, Hawke's Bay, Tararua, and Wairarapa. It includes:
Primary Producer Finance Scheme
The North Island Weather Events Primary Producer Finance Scheme is designed for businesses that have a reasonable chance of returning to viability with additional support. It aims to help these businesses re-engage with commercial lenders. The scheme is administered by Kānoa, Regional Economic Development & Investment Unit at the Ministry for Business Innovation and Employment.
The Primary Producer Finance Scheme is open for applications and Expressions of Interest for six weeks, from 31 July to 8 September 2023.

The Government is providing $4 million to help farmers, growers, whenua Māori owners and rural communities mobilise and co-ordinate recovery efforts. Read more here. This is initial funding to help with immediate and urgent needs. MPI is working closely with sector groups, including NZW, to identify areas of greatest need. They envisage the money may be used to:
Importantly, MPI will be working with the national response to ensure this is not replicating work already being done. At this point, individuals/businesses are not able to directly apply for this funding. Further support will be considered as full assessments of damage are carried out.

The Hawke's Bay Disaster Relief Fund provides financial support to residents and ratepayers of the Hawke’s Bay region who have been affected by Cyclone Gabrielle. This one-off hardship grant provides for damage or hardship incurred as a result of the cyclone. More information is available at the link below.
The Ministry of Social Development has provided a Community Support Package which aims to relieve pressure on community groups and contracted providers so they can continue to deliver their response and recovery efforts for individuals, whānau and communities. Recovery visa
To assist with recovery, the Government has announced the launch of the Recovery Visa (a Specific Purpose Work Visa). This short-term visa (lasting up to six months) will allow employers to sponsor migrants to come to New Zealand to work on the emergency response.

INZ aims process applications for the Recovery Visa within a week and many will be decided even quicker. See here for more information.
Other visa options
Employers wanting to recruit migrant workers for longer term roles are encouraged to use the existing Accredited Employer Work Visa (AEWV). Changes are being considered to this visa to support faster processing for identified roles that will support the recovery and rebuild. These roles will be exempt from the labour market test. More information on other visa pathways can be found here.
Migrant workers in New Zealand
Migrants already in New Zealand who need to change their role and location to assist with recovery will be able to do so for up to two months without breaching their visa conditions. They must stay with the same employer.
MSD can provide a range of business support for employers to assist in the recovery effort following Cyclone Gabrielle including staff retention, staff redeployment (temporary or permanent) and early response business closures. If you have had to make staff redundant, MSD may also assist with re-training, finding another job and financial support. Silt removal
If you have silt waste on a lifestyle block, farm or orchard, Hawke's Bay Regional Council (HBRC) can help remove larger volumes. Call HBRC on 06 835 9200 or 0800 108 838 and they will coordinate with a contractor to get it removed. Landowners are asked to remove the silt from around vines or trees and move it to a location on their own property with access for trucks.
At this time of the year orchardists are permitted to burn certain vegetation outdoors during May, June, July, and August, and normally the burning of prunings is NOT permitted. However, in the aftermath of Cyclone Gabrielle, prunings CAN be burnt in an effort to save trees and on affected land that is being cleared, including in airsheds.
